Terms of Service

These Terms of Service ("Terms") govern your engagement of food regulatory consulting services provided by FSSAI Consult and your use of our website www.fssaiconsult.com.

Key Engagement Principles

By engaging our services, you confirm that you are providing truthful business and product information. We provide professional regulatory filing & advisory support; final license approvals remain under the statutory jurisdiction of the Food Safety and Standards Authority of India (FSSAI).

1. About Us & Legal Entity

FSSAI Consult("we," "us," "our," or "the Company") is a specialized food compliance consultancy.

2. Scope of Services

2.1 What We Provide

  • FSSAI Basic Registration, State License, & Central License filings
  • Kind of Business (KoB) category determination under 2026 regulations
  • Annual Fee payment management & Form D1/D2 Annual Returns
  • FSSAI Product Approval (ePAAS portal) for non-specified foods
  • FSMS / HACCP plans, label audits, & inspection defense advisory

2.2 What We Do NOT Provide

  • We are NOT a government authority — we assist clients in dealing with authorities
  • We do NOT guarantee statutory approval dates (FSSAI controls processing windows)
  • We do NOT provide litigation court representation
  • AYUSH or CDSCO drug regulatory filings are outside our scope

3. Client Obligations

To enable efficient filing, you agree to:

  • Truthful Declarations: Provide complete, current, and genuine documents (premise proof, ID, turnover declarations).
  • Timely Responses: Respond to FSSAI deficiency queries within statutory windows (typically 30–45 days) to avoid application rejection.
  • Operational Compliance: Maintain actual physical hygiene, water test reports, and manufacturing standards at your business premise.
  • Ethical Conduct: Refrain from requesting fraudulent category misclassifications or illegal payments to officials.

4. Fee Structure & Payment Terms

Invoices are itemized under three distinct headers:

1. Government Fees: Statutory fees payable directly to FSSAI (FoSCoS/ePAAS), DGFT, or municipal bodies.

2. Third-Party Costs: NABL accredited laboratory test fees, notary charges, or courier fees.

3. Professional Service Fees: Our consulting, drafting, and filing support fees (+ 18% GST).

* Advance professional fee + government fee estimate is required to commence filing. Balances are payable upon application staging.

5. Limitation of Liability

Our total aggregate liability for any claim arising out of or in connection with our consulting services is strictly limited to the professional service fees paid by you to us for that specific engagement. We are not liable for indirect business losses, Swiggy/Zomato onboarding delays caused by FSSAI scrutiny, or statutory rejections stemming from inaccurate information supplied by the applicant.

6. Confidentiality & Data Protection

We maintain strict confidentiality over your business data, product formulations, and financial turnover figures. All client data processing is conducted in compliance with our DPDP-aligned Privacy Policy.

7. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall first be attempted to be resolved via good-faith negotiations for 30 days. Unresolved disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996 in Noida, Uttar Pradesh. Subject to arbitration, courts at Noida, Uttar Pradesh hold exclusive jurisdiction.
