FSSAI License Modification — Update Your License in 15 Working Days | 2026 Rules

If your food business has changed in any material way since you first obtained your FSSAI license — new products, new premises, ownership change, expansion into a new Kind of Business category — you're legally required to update your license through a modification application on FoSCoS within a specified window.

Under the 2026 Amendment Regulations, modification requirements were clarified and integrated with the new perpetual validity framework. Failure to file required modifications is treated as operating with an invalid license category — exposing you to enforcement penalties under Section 63 of the FSS Act, 2006, including fines up to ₹5 lakh and potential license suspension.

This page covers what qualifies as a modification, when you must file, the exact fees, documents, and step-by-step process — plus the critical distinction between modification and re-classification that trips up most FBOs.

What is FSSAI License Modification?

FSSAI License Modification is an application filed on the FoSCoS portal to update any material detail of your existing FSSAI license — while keeping the same 14-digit license number intact. Unlike a fresh application (which issues a new license) or renewal (a concept retired under 2026 rules), modification amends specific fields of your existing license record.

Modifications are governed by the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, and the updated procedural framework under the 2026 amendment. Some modifications are processed near-instantly with a nominal fee; others require detailed review, fresh documentation, and may take the same time as a new license application.

The Overarching Principle: Your FSSAI license must always accurately reflect your current business — what you sell, where you operate, who owns it, and under what KoB you're classified. Any material divergence between the license record and actual operations is a compliance breach.

Types of FSSAI Modifications

Non-Critical Modifications

Involve changes that don't materially alter risk profile or scope. Processed within 5–10 working days with ₹100 fee.

Examples:
  • Correction of applicant name spelling errors
  • Update of contact details (email, mobile)
  • Change of authorized signatory (no ownership change)
  • Minor updates to FSMS documentation
  • Address correction (typo, PIN code correction)
  • Update of nominated compliance person

Critical Modifications

Involve changes that alter scope, risk profile, or premises. Take 10–30 working days and ₹500 fee (may trigger inspection).

Examples:
  • Change of business premises (actual physical relocation)
  • Addition of new food product categories (dairy, nutraceuticals)
  • Change of business constitution (Prop → Pvt Ltd)
  • Ownership transfer / sale of business
  • Change of KoB category
  • Change in manufacturing capacity or process

Modification vs Re-Classification — Know the Difference

This is where most FBOs get confused and file the wrong application type. The distinction is legally important:

Modification:

Updates specific fields of your existing license while your license category remains unchanged. Example: Adding new food products to your existing State License, changing Central License premises within the same city.

Re-Classification:

Applies when the change requires shifting your license category — Basic Registration to State License, State License to Central License (or vice versa). Re-classification involves a fresh application under the target category.

Common Re-Classification Triggers:
  • Turnover crosses ₹1.5 Cr (Basic → State) or ₹50 Cr (State → Central)
  • Starting food import or export (any turnover → Central)
  • Listing on Zomato/Swiggy as cloud kitchen (Basic → State min)
  • Onboarding to Amazon/Flipkart pan-India (any → Central)
  • Expanding to a second state (State → Central)
  • Adding nutraceuticals, infant food, or proprietary foods (any → Central)
