1. Introduction and Its Compliance

FSSAI State License is the statutory food business authorization issued by state Food Safety Authorities under Section 31(1) of the Food Safety and Standards Act, 2006. It is mandatory for medium-sized food businesses operating within a single state with annual turnover between ₹1.5 Crore and ₹50 Crore, or specific high-activity categories regardless of turnover.

Applications are submitted via Form B on the FoSCoS portal (foscos.fssai.gov.in). Upon approval, the authority issues a 14-digit FSSAI State License Number (starting with digit '1') on a Format C Certificate.

Mandatory Compliance Requirements:

  • Display of License Certificate: Format C certificate must be framed and displayed at the primary entrance of your food unit.
  • 14-Digit FSSAI Mark on Packaging & Bills: Mandatory display of the 14-digit license number and FSSAI logo on all product labels, delivery packaging, and tax invoices.
  • Form D1 Annual Return Filing: Food manufacturers and processors holding a State License must file Form D1 annually on FoSCoS by May 31 for the preceding financial year.
  • Customized FSMS Plan Implementation: Food Safety Management System (FSMS) plan must be maintained on site for inspection.
  • Annual Maintenance Fee: Payment of annual fee (₹2,000 to ₹5,000) on or before your license anniversary date to maintain perpetual validity.

2. Why It Is Needed

Operating a mid-scale food establishment or cloud kitchen without a valid FSSAI State License exposes your business to catastrophic legal and financial risks:

Statutory Legal Penalties (Section 63)

Under Section 63 of the FSS Act, 2006, running a food business exceeding petty limits without a license is a non-bailable offense punishable with fines up to ₹5 Lakh, imprisonment up to 6 months, and immediate sealing of processing units.

Mandatory for Delivery Platforms (Swiggy / Zomato)

Under the 2026 KoB matrix, all Cloud Kitchens and commercial restaurants listed on food delivery apps (Swiggy, Zomato, EatSure) must hold at least an FSSAI State License regardless of turnover.

Immunity During Government Food Safety Inspections

State Food Safety Officers (FSOs) conduct unannounced risk-based inspections. A valid State License with an audited FSMS plan protects your operational continuity against immediate suspension notices.
